Terms and Conditions
These terms govern access to ToastBuddy, voice sessions, AI-assisted drafts, paid final outputs, email delivery, share pages, and related services.
1. Agreement to these Terms
These Terms and Conditions are a legally binding agreement between you and ToastBuddy. ToastBuddy, we, us, and our mean the operator of toastbuddy.com. You means the person who accesses or uses the website, voice coaching flow, generated drafts, checkout, final outputs, share pages, emails, support channels, or related services.
By accessing or using ToastBuddy, clicking a button that indicates acceptance, starting a voice session, saving a session, purchasing a final output, or continuing to use the service after these Terms are updated, you agree to these Terms and to the Privacy Policy. If you do not agree, do not use ToastBuddy.
2. The ToastBuddy service
ToastBuddy is a voice-first emotional storytelling coach that helps users talk through memories and turn them into personal writing, such as toasts, speeches, love letters, and song briefs. The service may include setup prompts, voice conversation, transcript capture, memory cards, AI-assisted coaching, draft previews, paid final outputs, cue cards, private share pages, email delivery, support, analytics, and related features.
ToastBuddy is not a professional writing agency, therapist, attorney, financial adviser, medical provider, emergency service, reputation-management service, or substitute for your judgment. You are responsible for reviewing, editing, fact-checking, and deciding whether any generated output is appropriate before you use, publish, perform, or share it.
3. Eligibility and authority
- You must be at least 18 years old, or the age of legal majority where you live, to make purchases through ToastBuddy.
- If you are under the age of majority, you may use ToastBuddy only with involvement and permission from a parent or legal guardian.
- You may not use ToastBuddy if you are barred from using the service under applicable law.
- If you use ToastBuddy on behalf of another person, organization, wedding party, employer, family member, or group, you represent that you have the authority and permissions needed to provide information and use the output for that purpose.
4. Accounts, sessions, and access
ToastBuddy may allow you to start an anonymous session, save a session with an email address, continue a voice conversation, purchase a final output, receive an email delivery, or access a private share page. You are responsible for the accuracy of the email address and information you provide.
Private session links, checkout links, delivery emails, and share pages may provide access to personal content. Keep them confidential. ToastBuddy is not responsible for access by people with whom you share a link, by people who can access your email, or through your device or browser.
5. User content and permissions
User Content means anything you submit, say, type, upload, generate, edit, or provide through ToastBuddy, including names, relationships, memories, stories, voice content, transcripts, facts, preferences, prompts, draft edits, and support messages.
You keep ownership of your User Content. You grant ToastBuddy a worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, transcribe, analyze, display, modify, create derivative works from, and otherwise process User Content as needed to provide, maintain, secure, support, improve, and measure the service, comply with law, and enforce these Terms. ToastBuddy will not publicly identify you or publish your private User Content in marketing materials without your permission.
You represent and warrant that you have all rights and permissions needed to provide User Content and to allow ToastBuddy and its providers to process it. You must not submit content that violates privacy rights, publicity rights, intellectual property rights, confidentiality obligations, court orders, employment obligations, platform rules, or applicable law.
6. Voice consent and recording-related responsibilities
When you use voice features, you consent to microphone capture, real-time audio processing, transcription, AI processing, session analytics, and storage of transcripts and related text-based session artifacts. Your browser or device may also ask for microphone permission.
You are responsible for complying with any consent laws that apply to people who may be heard, named, quoted, described, or otherwise included in your session. Do not record, submit, or disclose another person's private information unless you have the right to do so.
7. AI-generated output
ToastBuddy uses AI systems and related providers to help process conversations, extract useful details, and generate draft language. AI output may be inaccurate, incomplete, offensive, repetitive, unsuitable, or inconsistent with your expectations. Similar or identical output may be generated for other users.
Subject to your compliance with these Terms and applicable law, ToastBuddy does not claim ownership of the final personal writing output generated for your session. To the extent ToastBuddy has transferable rights in that output, ToastBuddy assigns those rights to you for your personal, social, or internal business use, including performing, editing, printing, emailing, or sharing the output for the event or purpose you created it for. This assignment does not include ToastBuddy's software, prompts, models, workflows, templates, branding, user interface, analytics, provider technology, or pre-existing materials.
You are solely responsible for reviewing, editing, verifying, and deciding how to use generated output. Do not use output in a way that defames someone, invades privacy, violates rights, breaks the law, misleads an audience, or causes harm.
8. Purchases, pricing, taxes, and refunds
ToastBuddy may offer one-time purchase tiers for final outputs or related deliverables. Prices, features, and availability may change before checkout. The price shown at checkout controls the purchase you make. Payments are processed by Stripe or another payment processor, and your payment method may be subject to that processor's terms.
Amounts are charged in U.S. dollars unless otherwise stated. You are responsible for any taxes, fees, exchange costs, bank charges, or payment-provider charges that apply to your purchase.
Because ToastBuddy provides personalized digital content and AI-assisted generated output, completed purchases are generally non-refundable once the final output is generated, delivered, downloaded, or made available, except where required by law or where ToastBuddy determines in its discretion that a refund, credit, or regeneration is appropriate for a technical failure or service issue.
If you believe there was a billing error, duplicate charge, failed delivery, or technical issue, contact support@toastbuddy.com promptly with the checkout email, approximate purchase time, and relevant session information.
9. Acceptable use
You may use ToastBuddy only for lawful, personal, and legitimate business purposes related to creating appropriate personal writing and related outputs. You agree not to misuse the service.
- Do not use ToastBuddy to harass, humiliate, threaten, exploit, defame, stalk, discriminate against, or incite harm against any person or group.
- Do not submit illegal content, sexual content involving minors, non-consensual intimate content, hateful content, instructions for wrongdoing, malware, secrets, stolen data, or content that violates another person's rights.
- Do not impersonate another person, misrepresent facts, fabricate consent, or create output intended to deceive audiences about material facts.
- Do not interfere with, scrape, overload, reverse engineer, crawl, resell, sublicense, copy, frame, or bypass the service, its rate limits, paywalls, security controls, or provider restrictions.
- Do not use automated systems, bots, prompt attacks, security testing, model extraction, or data-mining techniques without our written permission.
- Do not use ToastBuddy to develop a competing service or to benchmark, evaluate, or extract non-public product logic unless we have given written permission.
10. ToastBuddy intellectual property
ToastBuddy and its licensors own the website, software, code, product flows, voice coaching system, prompts, templates, designs, logos, names, trademarks, service marks, visual elements, analytics, documentation, and other materials that are not User Content or your assigned output.
Subject to these Terms, ToastBuddy grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the service for its intended purpose. No rights are granted except as expressly stated in these Terms.
11. Third-party services
ToastBuddy relies on third-party providers for functions such as hosting, database storage, AI processing, voice features, payment processing, email delivery, analytics, advertising measurement, security, and support. These providers may process information as described in the Privacy Policy and may have their own terms, policies, and technical limitations.
ToastBuddy is not responsible for third-party services, websites, payment processors, AI providers, outages, failures, delays, policies, content, or security incidents outside ToastBuddy's reasonable control.
12. Privacy
The ToastBuddy Privacy Policy explains how we collect, use, disclose, and protect personal information. By using ToastBuddy, you acknowledge that your information will be handled as described in the Privacy Policy.
13. Service availability and changes
ToastBuddy may change, suspend, limit, discontinue, or update any part of the service at any time, including free features, paid tiers, pricing, generation limits, voice providers, models, workflows, analytics, storage, or support channels. We may also fix bugs, apply security controls, reject or remove content, and restrict access to protect users, the service, or third parties.
We do not guarantee that the service will always be available, uninterrupted, secure, error-free, or compatible with every browser, device, microphone, payment method, email provider, or network.
14. Disclaimers
ToastBuddy is provided as is and as available. To the maximum extent permitted by law, ToastBuddy disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, quiet enjoyment, availability, and any warranties arising from course of dealing or usage of trade.
ToastBuddy does not warrant that generated output will be accurate, unique, legally safe, emotionally appropriate, culturally appropriate, accepted by an audience, free of bias, free of errors, or suitable for any particular event. You use the service and output at your own risk.
15. Limitation of liability
To the maximum extent permitted by law, ToastBuddy and its owners, employees, contractors, agents, providers, licensors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, or for lost profits, lost revenue, lost data, loss of goodwill, reputational harm, emotional distress, service interruption, computer damage, or cost of substitute services, even if advised of the possibility of those damages.
To the maximum extent permitted by law, ToastBuddy's total liability for all claims arising out of or relating to the service, output, purchases, or these Terms will not exceed the greater of the amount you paid ToastBuddy for the transaction giving rise to the claim or one hundred U.S. dollars.
Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, liability is limited to the greatest extent permitted by law.
16. Indemnification
You agree to defend, indemnify, and hold harmless ToastBuddy and its owners, employees, contractors, agents, providers, licensors, and affiliates from and against any claims, demands, actions, losses, liabilities, damages, judgments, settlements, penalties, fines, costs, and expenses, including reasonable attorneys' fees, arising from or relating to your User Content, your output, your use of the service, your violation of these Terms, your violation of law, your violation of another person's rights, or your misuse of third-party services connected to ToastBuddy.
17. Termination and enforcement
You may stop using ToastBuddy at any time. We may suspend or terminate access, refuse service, cancel or block transactions, remove content, limit features, or take other enforcement action if we believe you violated these Terms, created risk, abused the service, caused payment or security problems, or used ToastBuddy in a way that may harm ToastBuddy, users, providers, or third parties.
Sections that by their nature should survive termination will survive, including provisions about ownership, licenses, payment records, disclaimers, limitation of liability, indemnity, dispute resolution, and general terms.
18. Governing law and disputes
These Terms and any dispute arising out of or relating to ToastBuddy are governed by the laws of the State of Texas and applicable U.S. federal law, without regard to conflict-of-law rules, except where the law where you live requires otherwise.
Before filing a claim, you agree to email support@toastbuddy.com with a written description of the dispute and allow at least 30 days for an informal resolution. If a dispute cannot be resolved informally, the parties agree to bring claims only in the state or federal courts located in Texas, except that either party may bring an individual claim in small claims court where permitted by law or seek injunctive relief for misuse of intellectual property, security systems, or confidential information.
To the maximum extent permitted by law, disputes must be brought only on an individual basis, and not as a plaintiff or class member in a class, consolidated, representative, private attorney general, or collective action.
19. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the effective date and provide additional notice when required by law. The updated Terms apply to use of ToastBuddy after they become effective. If you do not agree to updated Terms, stop using ToastBuddy.
20. General terms
These Terms, together with the Privacy Policy and any checkout terms shown to you, are the entire agreement between you and ToastBuddy for the service. If any provision is found unenforceable, the remaining provisions will remain in effect and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, financing, reorganization, sale of assets, or operation of law. Failure to enforce a provision is not a waiver. Headings are for convenience only.
